What the bill says
On the agenda for Board of County Commissioners — 2026-06-02 — 2026-06-02. Agenda section: CONSENT
Background
The Transferable Development Rights (TDRs) Reserve Program allows citizens to sell and purchase TDRs through the county government instead of through private buyer/seller negotiations. The program operates as a revolving bank to continually purchase development rights from TDR owners and sell them to individuals and developers who need them. Per county code the TDR Reserve (Reserve) may resell TDRs only to be applied to projects pending approval by the Department of Planning & Zoning.
Discussion
The applicants have applied to purchase a total of three TDRs from the Reserve at a price of $6,000 per TDR, for a total of $18,180 including $180 in administrative fees. The TDRs are required for final approval of their minor subdivision application. The Department of Planning & Zoning has determined that the three TDRs are available for resale. The Conveyance of Development Rights forms have been reviewed for accuracy and legal sufficiency by Planning & Zoning and the County Attorney’s Office. Payment of $18,180 shall be made to the Department of Planning & Zoning and deposited in the revolving fund.
