With respect to the requirement of clause 3(c)(3) of rule XIII of the Rules of the House of Representatives and section 402 of the Congressional Budget Act of 1974, the Committee has received the enclosed cost estimate for H.R. 5213 from the Director of the Congressional Budget Office:
H.R. 5213 would prohibit any state or unit of local government from receiving funds under the Edward Byrne Memorial Justice Assistance Grant Program (JAG) if they have a policy or law that limits cash bail for criminal offenses that pose a threat to public safety and order. Under the JAG program, the Department of Justice awards grants to state, territorial, local, and tribal governments to support a variety of criminal justice and law enforcement activities. The Congress appropriated $964 million to the JAG program for fiscal year 2026. Though some entities could become ineligible for grants under the bill, CBO expects that enacting H.R. 5213 would not change the total amount required for the JAG program. Thus, CBO estimates that any costs to implement H.R. 5213 would be insignificant. Any related spending would be subject to the availability of appropriated funds.
